CHAPTER 87.

Passed March
23, 1865.

AN ACT to amend and re-enact sections fifty-
five and fifty-eight of Article second of the
Code of Public Local Laws relating to the sate
of spirituous liquors to minors and persons of
color, in the city of Annapolis.

Amended and
re-enacted.

SECTION 1. Be it enacted by the General Assem-
bly of Maryland, That section fifty-five of Article
second of the Code of Public Local Laws, be and
the same is hereby amended and re-enacted, so as
to read as follows :

55. It shall not be lawful for any person, whether
licensed to sell spirituous liquors or not, to sell, dis-
pose of, barter or give, within the corporate limits
of the city of Annapolis, or within five miles
thereof, any spirituous or fermented liquors or cor-
dials of any kind, or in any quantity whatever, to
any youth or minor under the age of twenty-one
years without the written order of the parent or
guardian of such minor, and any person violating
the provisions of this section shall be liable to
indictment in the Circuit Court for Anne Arundel
county, and upon conviction thereof, shall be fined
a sum not less than fifty dollars, nor more than
two hundred dollars for the first offence; and if
convicted the second time for a like offence be fined
a sum not less than one hundred dollars nor more
than four hundred dollars, and be confined in the
jail of said county until said fines shall be paid,
the fines herein incurred to be collected in the
same manner as similar fines are now collected by
law.

Amended and
re-enacted.

Sec. 2. And be it enacted. That section fifty-eight
of said Article, be and the same is hereby amended
and re-enacted so as to read as follows :

Order not to
extend over
two days.

58. Any one order which may be given to any
minor under the provisions of the fifty-fifth section
of [of] this Article shall not be available for the
purpose for which it was given, for a longer period
than two days from its date.

In force'

Sec. 3. And be it enacted, That this act shall
take effect from the date of its passage.
