WORCESTER COUNTY— Not iawM for any

person to catch or take away oysters

from the waters of Synnapuxent

Bay, in Worcester county, between
|
 
|
 
|
the last day of April and the first
|
 
|
 
|
day of September, in any year, nor
|
 
|
 
|
shall any bysters be taken from any
|
 
|
 
|
part of said Bay during that time
|
 
|
 
|
to plant in any other part of the
|
 
|
 
|
waters thereof; nor shall it be law-
|
 
|
 
|
ful at any time to use rakes or
|
 
|
 
|
dredges in taking or catching oys-
|
 
|
 
|
ters in this Bay.

Before it shall be lawful for any one
|
 
|
 
|
to catch or take oysters from said
|
 
|
 
|
Bay, they are to first obtain a written
|
 
|
 
|
permit from all the acting Justices
|
 
|
 
|
of the Peace in District number
|
 
|
 
|
three, so to do, which permit is to
|
 
|
 
|
expire on the last of April annually,
|
 
|
 
|
and shall limit the quantity to be
|
 
|
 
|
taken in any one week to ten bush-
|
 
|
 
|
els, and to be granted only to resi-
|
 
|
 
|
dents of this State; and any person
|
 
|
 
|
taking oysters from said Bay with-
|
 
|
 
|
out such permit, or exceeding the
|
 
|
 
|
quantity named therein, to be
|
 
|
 
|
deemed a violation of this act, each
|
 
|
 
|
justice of the peace to be entitled to
|
 
|
 
|
receive fifty cents for every permit so
|
 
|
 
|
granted,
|

Any person violating this act upon
|
 
|
 
|
conviction, before a justice of the
|
 
|
 
|
peace, for every offence to forfeit and
|
 
|
 
|
pay to the informer the sum of ten
|
 
|
 
|
dollars, with all costs of prosecution;
|
 
|
 
|
and if a negro, and unable to pay
|
 
|
 
|
the fine, the justice of the peace
|
 
|
 
|
shall order the constable to inflict
|
 
|
 
|
upon his person not over thirty-nine
|
 
|
 
|
lashes.
