Punishments," subtitle "House of Correction," be and the same
is hereby repealed and re-enacted with amendments so as to
read as follows:

SEC. 469. When any person is convicted in any court of
this State of any misdemeanor, punishable under the laws of
this State by imprisonment in jail or in the penitentiary or
by fine and imprisonment in jail or the penitentiary, such court
shall have power in its discretion to sentence such person to
be confined in the House of Correction, instead of the peni-
tentiary or jail; provided, that the the term of confinement
in the said House of Correction shall not be for a less period
than may now or hereafter be lawfully imposed for the offense
of which such person was so convicted, and that such person
so sentenced to confinement in said House of Correction be
not sentenced to be confined therein for a longer period than
three years.

SEC. 2. And be it further enacted, That a new section be and
the same is hereby added to Article 27 of the Code of Public
General Laws of Maryland (Code of 1904), title "Crimes and
Punishments," subtitle "House of Correction," to follow imme-
diately after Section 469, to be known as Section 469A, and to
read as follows:

SEC. 4691. When any person is convicted before any Justice
of the Peace of Maryland, having criminal jurisdiction of any
misdemeanor punishable under the laws of this State by im-
prisonment in jail, or by fine and imprisonment in jail, the said
Justice of the Peace shall have power in his discretion to sen-
tence such persons to be confined in the House of Correction
instead of jail, provided that the said term of confinement in
the said House of Correction shall not be for a less period than
two months, nor for a greater period than three years.

SEC. 3. And be it further enacted, That nothing in this Act
shall apply to or affect the prosecution of any offense which
may have been committed prior to the passage of this Act,
or the punishment provided for such offense.

SEC. 4. And be it further enacted, That this Act shall take
effect from the date of its passage.

AN ACT to add two additional sections to Article 27 of the
Code of Public General Laws of Maryland of 1904, title
"Crimes and Punishments," subtitle "III. Place of Refor-
mation and Punishment," said additional sections to follow
