Act who shall pray an appeal to the said Court shall be held
by recognizance or be committed to the county jail to appear
before the next regular jury term of the Circuit Court for
Garrett County.
SEC. 7. And be it enacted, That the Mayor and Town Council
of Kitzmillersville be and they are hereby authorized and
empowered to negotiate, sell and dispose of the said bonds as
hereinbefore provided in Section 5 of this Act, or so many
thereof as the Mayor and Town Council may be deemed neces-
sary for the purposes of this Act, and the said Mayor and Town
Council are fully authorized to make all rules and regulations
and to pass all necessary ordinances with penalties for their
violation and to do all other necessary acts for the proper
managing, maintaining and repairing the said waterworks and
sewerage system and for the protection thereof.
SEC. 8. And be it enacted, That the funds realized from the
sale of said bonds shall be applied for the purposes of this Act
and shall be paid by check signed by the Mayor and President
of the Council, and the said Mayor and Town Council of Kitz-
millersville are hereby authorized and empowered to pass such
orders for payment of money due for the construction of said
waterworks and sewerage, or the contractor or contractors for
the construction of the same, as shall, from time to time, be
earned by the contractor or contractors in the prosecution of
said works, and also, from time to time, to pass orders for the
payment of property purchased or condemned and for materials
furnished in pursuance of the provisions of this Act., and may,
in its discretion, employ a competent hydrographical engineer
to superintend the work of constructing such waterworks and
sewerage.
SEC. 9. And be it enacted, That on the first Tuesday in May,
1910, there shall be a special election held in the town of Kitz-
millersville, which election shall be held in the same manner
and under the same regulation as other municipal elections
held in said town, for the purpose of submitting the question
as to whether this Act shall 'take effect, to all legal voters of
said town who are qualified to vote at a State election, and all
ballots at said election shall have printed on them the words,
"Against Water and Sewerage," and the words, "For Water
and Sewerage," and all voters desiring to vote for the pro-
visions of this Act shall mark out the words "Against Water
and Sewerage," and all voters desiring to vote against the pro-
visions of this Act shall mark out the words "For Water and
Sewerage," and if a majority of the votes are cast "For Water
and Sewerage," then this Act shall be in full force of law,
otherwise have no effect. The judges of election shall, under
