ARTICLE XVI.

CHANCERY.

CHAPTER 59G.

AN ACT to repeal and re-enact with amendments Section 111 of
Article 16 of the Code of Public General Laws of Maryland,
title "Chancery," subtitle "Non-residents," as said section
was repealed and re-enacted by Chapter 637 of the Acts of
1892, said section being numbered Section 123 of Article 16
of the 1904 Code of Public General Laws of Maryland.
SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Section 111 of Article 16 of the Code of Public
General Laws of Maryland, title "Chancery," subtitle "Non-
residents," as said section was repealed and re-enacted by
Chapter 637 of the Acts of 1892, said section being numbered
Section 123 of Article 1G of the 1904 Code of Public General
Laws of Maryland, be and the same is hereby repealed and re-
enacted with amendments so as to read as follows:

123. In cases where it is unknown whether a non-resident
be living or dead the bill may be filed against him as if living,
and in cases where the non-resident is known to be dead, but
it is unknown whether he left any heirs, or if he is known to
have left heirs, but the .heirs be unknown, and in cases where
it is unknown whether a deceased person, resident or non-resi-
dent, who, if living, would be a proper party to a bill in chan-
cery, lias left any heirs; or if he is known to have left heirs,
but the heirs be unknown, in all such cases the bill may de-
scribe such unknown heirs as the heirs of the person who, if
living, would be a proper party; and in cases where a non-resi-
dent is dead and no letters testamentary, or of administration,
have been granted in this State; and if it is unknown whether
such letters upon his personal estate have been granted else-
where, the bill may describe as the executor or administrator
of such deceased person the personal representative of the
person who, if living, would be a proper party; and the bill in
cases under this section shall pray that notice of the substance
and object thereof may be given by publication as provided by
law in cases of non-residents.

SEC. 2. And be it further enacted. That this Act shall take
effect from the date of its passage.
