property of said proprietor or owner at any time when the
ascertainment of the proportion of such proprietor or owner
shall be made by the street committee; provided that twenty
days' previous notice in writing shall be given to the said pro-
prietor or owner of the time and place at which the amount
of his or her assessments is to be fixed, and any such owner
shall be heard at such time, and said owner shall also be en-
titled to a ten days' notice before suit is brought or distress
proceedings instituted. This provision to apply to paved and
unpaved streets.

SEC. 2. And be it enacted, That this Act shall take effect
from the date of its passage.

CHAPTER 115.

AN ACT to repeal Sections 39, 40, 41, 42, 43, 43A, 43B, 43C, 43D,
43E, 43F, 43G, 43H, 43I, 43J, 43K and 43L of the Public Local
Laws of Maryland, title "Allegany County," sub-title "Coun-
ty Treasurer and Taxes," as enacted by Chapter 413 of the
Acts of 1902 and Chapter 355 of the Acts of 1904, and to re-
enact said section with amendments under the title "County
Treasurer and Taxes," and to amend sections under the title
"County Treasurer and Taxes;" by re-enacting said sections
to be known as Sections 39, 39A, 39B, 40, 41, 4lA, 42, 42A,
43A, 43B, 43C, 43D, 43E and 43F.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Sections 39, 40, 4lA, 42, 43, 43A, 43B, 43C, 43D, 43E,
43F, 43G, 43H, 43I, 43J, 43K and 43L of Article 1 of the Code
of Public Local Laws, title "Allegany County," sub-title
"County Treasurer and Taxes," as enacted by Chapter 413 of
the Acts of 1902, and Chapter 355 of the Acts of 1904, be and
the same are hereby repealed and re-enacted, to be known as
Sections 39, 39A, 39B, 40, 41, 4lA, 42, 42A, 42B, 43 43A, 43B,
43c, 43D, 43E and 43F, respectively, under the title "County
Treasurer and Taxes," and that said sections be and the same
are hereby added to Article of the Code of Public Local Laws,
title "Allegany County," so as to read as follows:

39. At the General Election for county officers for Alle-
gany County to be held in said county in the month of Novem-
ber, nineteen hundred and eleven, and every two years there-
after, a County Treasurer shall be elected by the qualified
voters of said county, who shall hold the office of Treasurer
for a term of two years from the first day of April next after
his election and qualification, or until his successor is elected
