the attention of the Mayor or Engineer shall have been called
thereto by notice thereof in writing at least twenty-four hours
prior to the occurrence of the injury or damage, and proper
diligence has not been used to rectify the defect after actually
known or called to the attention of the Mayor and Engineer
as aforesaid.

SEC. 119. The Health Officer, Attorney, Engineer, Auditor
and Chiefs of Police and Fire Departments shall attend all
regular meetings of the Mayor and City Council, and any
special meetings of said Mayor and City Council, at which
their presence may be requested by any member of the City
Council. They shall have the privilege of participating in the
discussion of matters relating to their respective departments,
but shall have no vote.

SEC. 120. All official bonds required under this Act, except
the bonds of the members of the Mayor and City Council, shall
be made payable to the Mayor and City Council of Cumber-
land, and shall be in such form and with such sureties as the
Mayor and City Council may prescribe.

SEC. 121. The Mayor and City Council shall have authority
from time to time to create and fill, and discontinue all offices
and employments other than herein prescribed, according to
their judgment of the needs and requirements of the city, and
in their discretion, by a majority vote of all the members of
the City Council, to remove for or without cause, the incum-
bent of any such office or employment, and may, and by order
or otherwise prescribe, limit or change the compensation of
such officers or employees.

SEC. 122. In case of sickness or absence, or inability from
any cause on the part of any official to perform his duties, the
Mayor and City Council may provide for the performance of
such duties by a temporary substitute of such officer, or other-
wise, as they may deem best, and the acts performed by such
substitutes or otherwise, as the said Mayor and City Council
may direct, shall be deemed as valid for all intents and pur-
poses as though performed by the said official himself.

SEC. 123. All the officials of said city, charged with dis-
bursing, safe-keeping or performing any acts touching the
taxes or other revenues of said city, now due, or that may here-
after become due, shall be liable for any and all breaches of
duty touching same, as are the State and county officials, in
regard to like services and acts, and may be proceeded against,
criminally and civilly, in the same way.

SEC. 124. The Mayor and City Council shall have the power
to remove any officer for incompetency, inefficiency, corrup-
