days thereafter, take an appeal to the Crcuit Court for Allegany
County, which is hereby given jurisdiction of the same, and
the said Court shall ^hereupon, as speedily as possible, hear
the said charges de novo, and pass such order in the premises
as the said Court may deem proper, and the action of the said
Court shall be final; and pending such appeal, the said Mayor
or Councilman shall be suspended without pay; provided,
however, that if the said charges shall not be sustained by said
Court, then the said Mayor or Councilman charged as afore-
said shall be entitled to full pay from the time of the order of
dismissal passed by the said Mayor and City Council. The
Commissioner named as the head of each department shall audit
all accounts or claims against it, unless he be absent or fail or
refuse to do so, in which event the Mayor shall appoint another
Councilman to act in his stead during his absence, or to audit
such claims and accounts as the said Commissioner shall fail
or refuse to act upon, but before payment, all accounts shall
be acted upon and approved by a majority of those present at
a meeting of said Mayor and City Council.
Said Council shall require a statement to be published in
January, April, July and October of each year, in two news-
papers of said city, showing a full, clear and complete state-
ment of all taxes and other revenues collected and expended
during the preceding quarter, indicating the respective sources
from which the moneys are derived, and also indicating the
disposition thereof, and it shall be the duty of the Commis-
sioner of every department to make a report in writing at the
first meeting of the Mayor and City Council each and every
month of the conditions in his department during the preceding
month.
SEC. 110. That whenever the Mayor shall deem it necessary,
in order to enforce the laws of the city, or to avert danger or
protect life or property, in the case of a riot or any outbreak
or calamity or public disturbance, or when he has any reason
to fear any serious violation of the law or order or any outbreak,
or any other danger to said city or the inhabitants thereof,
he shall summon into service, as a special police force, all, or
as many of the citizens as in his judgment and discretion may
be necessary and proper; and such summons may be by procla-
mation or order, addressed to the citizens generally, or those
of any ward of the city or subdivision thereof, or such sum-
mons may be by personal notification; such special police,
while in service, shall be subject to the orders of the Mayor,
shall perform such duties as he may require, and shall have the
same powers while on duty as the regular police force of said
city; and any person so summoned and failing to obey, or
appearing and failing to perform any duty that may be re-
