to the State of Maryland in not less than the amount of the
contract price. To all such bids there shall be attached the
certified check of the bidder, and the bidder who has the con-
tract awarded to him and who fails to promptly and properly
execute the contract and bond shall forfeit the said contract.
The said check shall be taken and considered as liquidated
damages, and not a penalty for failure of said bidder to execute
said contract and bond. Upon the execution of said contract
and bond by a successful bidder his check shall be returned to
him. The amount of said check shall be five hundred dollars.
The checks of the unsuccessful bidders shall be returned to
them after opening the bids and awarding the contract to the
successful bidder; provided, however, that said Commission,
with the consent of a majority of all its members, may itself
do any part or parts of any such work under such conditions
in every respect as it may prescribe by day labor or otherwise.
Provided, however, that at any time after the 25th day of
March, 1910, the Governor may, in his discretion, appoint one
additional member of the State Roads Commission, who shall
be a competent person, a citizen, and a resident of this State
for not less than ten years, and who shall give his entire time
to the performance of the duties to which he is appointed, and
who shall as appointed receive as compensation for services a
salary of two thousand dollars ($2,000) per annum, payable in
equal monthly instalments, and who as and when appointed
with the Governor, ex-officio, and the other five appointees pro-
vided for in this subtitle, and their successors in office, shall
thereafter be and constitute the special Commission to be
known as the State Roads Commission provided for in this
subtitle, with all the powers and duties, and subject to all
the restrictions as to terms of office and otherwise provided as
to the State Roads Commission in this subtitle, and the said
additional member, who shall give his entire time to the duties
of his office, may be specially assigned to such work as the
State Roads Commission shall direct, or to the preparing and
accumulation of road-building material in any of the counties,
or at some point on the Susquehanna River, or elsewhere, con-
venient to economical distribution by water among the tide-
water counties of this State; and provided further, that no
officer or employee of the State Roads Commission shall be or
become pecuniarily interested in any contract for work or ma-
terials in connection with any of the work of said Commission.

32F. Each county in which a State highway, or any section
thereof lies, shall at its own expense keep such highway clear
of all obstructions, except ice; to be reasonably safe for travel.
The County shall have police jurisdiction of and for all State
highways within its limits, and shall forthwith give notice in
