1904, title "Militia," as amended by Chapter 103, Acts of 1908,
be and the same are hereby repealed and re-enacted with
amendments so as to read as follows:

17. No officer of the Militia shall incur any expense what-
ever to be paid by the State, except such as authorized in this
chapter, without first obtaining the authority of the Com-
mander-in-Chief. In extreme emergencies, however, the com-
manding officer of any organizations or detachment of the Na-
tional Guard may make purchase of such necessities as are
absolutely required for the immediate use and care of his
command, taking receipts in duplicate therefor; a report of
such action, containing a statement of the articles purchased
and the price thereof, with the receipts attached, must be made
forthwith through the regular channels to the Acting Quarter-
master-General. The Comptroller of the State shall be the au-
ditor of all accounts for property purchased by the Adjutant-
General (as acting Quartermaster-General) and copies of the
orders or contracts under which such purchases are made shall
be filed in the office of the assistant to the acting Quartermas-
ter-General, subject to his inspection. All other military ac-
counts payable by the State shall be audited by the Adjutant-
General. Military accounts thus audited shall be paid by the
Treasurer of the State from a proper appropriation made by
the Legislature, upon, the warrant of the Adjutant-General,
under and by direction of the Governor and Commander-in-
Chief.

26. The officers in these Staff departments shall be appoint-
ed and commissioned by the Commander-in-Chief at his discre-
tion. The non-commissioned officers provided for in these de-
partments shall be warranted by the Brigade Commander.

36. When the Governor desires to create new organizations
he shall have power in the first instance to appoint all the
officers necessary to commence and complete such organiza-
tions.

38. The Governor and Commander-in-Chief, at his discre-
tion, shall issue orders for the election of the Brigade Com-
mander and Commanding Officer, Naval Brigade. The Com-
manding Officer, First Brigade, shall issue orders for the elec-
tion of the field officers of the respective regiments and all offi-
cers of the separate organizations of the brigade. The com-
manding officers of the regiments and the Naval Brigade shall
issue orders for the election of the company and divisional
officers of their respective organizations. The officer ordering
an election shall detail an officer to preside thereat, and shall
give or cause to be given at least five days' notice to all quali-
fied voters when and where and for what office the election
