making arrests for infraction of the laws of the State and the
ordinances of the city as are now or may hereafter be allowed
constables in criminal cases. All fines for violation of the pro-
visions of this charter or ordinance of the city shall when col-
lected be immediately paid over to the clerk of the Council,
with the names of the persons from whom collected, and depos-
ited by him to the credit of said city.
72. Upon complaint in writing against any official of said
city for dereliction of duty and a trial before the Mayor and
Council, and after notice to the party complained of informing
him of that with which he is charged, and notifying him to
appear and defend himself, first having been given him in writ-
ing at least five days before trial, then if the Council find any of
said officers, including the clerk to the Council, treasurer or
collector, as thereinafter provided for, to be guilty conduct
unbecoming an officer, disobedience, neglect of duty, misfeas-
ance or malfeasance in office, such officer may be removed at
once from his office by a majority vote of the trial board, and
his office shall be declared vacant; and the Mayor shall, on
being notified thereof, as soon as convenient thereafter, appoint
another person to fill said office so vacated for the unexpired
term, which appointment shall be submitted to the Council for
confirmation, and when confirmed the new appointee shall take
the same oath of office as taken by the removed officer and in
the same manner, and to be returned to the clerk of the Council
and recorded as heretofore provided, and the new officer shall
have the same powers and duties as if he had been appointed in
the first place, and he shall serve out the unexpired term of the
removed officer.
73. At. the first regular meeting in July biennially after his
election the Mayor shall appoint one person, a resident and
qualified voter of this city, not a member of the Council, to act
as clerk to the council and collector of city taxes and treasurer,
who may be the same person, for the term of two years, or until,
his or their successors is or are duly qualified, subject, as other
officers are appointed, to confirmation by the Council. The
said officer to receive such compensation as shall be agreed
upon, and he or they shall perform all the duties imposed on
him or them by law or ordinance of the city.
74. The said clerk, treasurer and collector, or any of them,
before entering upon the performances of the duties of his office
shall take and subscribe an oath before the Mayor or a justice
of the peace residing in said city that he will well and faithfully
perform the duties of his office according to law and the ordi-
nance of said city, which oath is to be returned to the Council
and recorded as the oaths of other officers, which oath, record
