legal open season for hunting or killing the same, that it shall
be also unlawful for any person or persons, firm, partnership
or corporation to re-sell any part of the body or bodies of the
aforesaid birds, quail (partridge) or rabbit; provided, how-
ever, that nothing herein shall apply or be construed to pre-
vent any person or persons, firm, partnership or corporation
from having in possession by purchase or otherwise any live
bird of any kinds above mentioned, or live rabbit, for the pur-
pose of preservation and propagation; and nothing herein shall
prevent the person who shall first kill or catch any of said
quail (partridge) or rabbit from selling the same if sold not
to be re-sold.

SEC. 34 A-3. And be it further enacted, That any person
or persons violating any of the provisions of this Act shall
upon conviction thereof before any Justice of the Peace, having
criminal jurisdiction in said county, or in the Circuit Court for
said County, be fined the sum of ten dollars ($10.00) for each
and every bird, quail (partridge) or rabbit unlawfully killed,
hunted or, re-sold or offered for re-sale hereinbefore mentioned,
and to stand committed to the county jail until such fine and
costs of prosecution are paid.

SEC. 2. And be it further enacted, That this Act shall take
effect from and after its passage as provided by the constitu-
tion of Maryland, and that all Acts General or Local inconsist-
ent herewith are hereby repealed. ,

AN ACT to repeal and re-enact, with amendments, Section 134
of Article 27 of the Code of Public General Laws of Mary-
land, entitled '' Crimes and Punishments,'' sub-title '' Fraud—
Boarding House, Hotel and Livery Stable Keepers,'' so that
the same may include within its scope Hospitals and Sani-
tariums, t

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Section 134 of Article 27 of the Code of Public Gen-
eral Laws of Maryland, entitled "Crimes and Punishments,"
eub-title "Fraud—Boarding House, Hotel and Livery Stable
Keepers,'' be and the same is hereby repealed and re-enacted
with amendments to read as follows:
