burg, in Montgomery county, as enacted by chapter 292 of the
Acts of the General Assembly of Maryland, at the session of
1906, be and the same is hereby repealed and re-enacted, and
that a new section be and the same is hereby added to the said
charter of the town of Gaithersburg, to follow section 34, and
to be known as section 34A, the said section 34 and 34A to read
as follows:
SEC. 34. The Baltimore and Ohio Railroad Company is re-
quire,d to keep a flagman or signalman stationed during each
and every day from seven o'clock A. M. to nine o'clock P. M. in
each year at each of the crossings of its railroad over Frederick
avenue, over Chestnut street, and over Summit avenue (other-
wise known as the Goshen road) in said town, to warn persons
using said street and crossings over said railroad at said cross-
ings of the approach of trains upon said railroad.
SEC. 34A. The said Baltimore and Ohio Railroad Company
shall be liable to pay a fine of $50.00 for each and every day
that it shall fail or neglect to comply with the provisions of the
preceding section; said fine to be recovered in an action in the
name of the State of Maryland before any justice of the peace
of the State of Maryland, in and for Montgomery county, and
to be paid, when collected, into the road fund of said town, in
any such proceedings service of summons upon any ticket agent
shall be sufficient service upon -said railroad company.

CHAPTER 534.
AN ACT to provide for ah additional justice of the peace for
the Fifth Election District of Montgomery county.
SECTION 1. Be it enacted by the General Assembly of Mary-
land, That the Governor be and is hereby authorized and em-
powered to appoint an additional justice of the peace in and
for the Fifth Election District of Montgomery county.
SEC. 2. And 5e it enacted, That this Act shall take effect
from the date of its passage.
