miles of Central Chapel, situated about one mile north of New
London, in Frederick county, whether or not made or manu-
factured by the person offering to make such sale, barter or
distribution thereof, nor shall any license be issued by the
clerk of the Circuit Court of Frederick county, Maryland, or
granted within the aforesaid limits for the sale of any of the
liquors, drinks or beverages herein mentioned; provided, that
nothing in this Act shall prohibit the sale of cider and home-
made wine within said limits by the maker or manufacturer in
quantities not less than one barrel when the same is not to be
used or consumed on the premises where sold.

SEC. 2. And be it enacted, That any person convicted of
the violation of this Act in any court having jurisdiction
of the offense shall for the first offense be fined in the sum
of not less than fifty dollars nor more than two hundred
dollars, and for a second offense not less than one hundred
dollars nor more than five hundred dollars, and on failure
to pay the fine and costs imposed by the court trying the
offender, the court may in its discretion commit the offender
for a first offense to the county jail for not exceeding sixty
days, and for a second offense for not more than one year.

SEC. 3. And be it enacted, That this Act shall take effect
from and after the first day of May, 1908.

CHAPTER 728.

AN ACT to amend the charter of the Burgess and Commission-
ers of Middletown, in Frederick county, by repealing and re-
enacting with amendments section 352 of article 11 of the
Code of Public Local Laws of Maryland, title "Frederick
County," sub-title "Middletown," as amended by chapter 96
of the Acts of the General Assembly of Maryland of 1896.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That section 352 of article 11 of the Code of Public Local
Laws of Maryland, title "Frederick County," sub-title "Middle-
town," as repealed and re-enacted by chapter 96 of the Acts of
the General Assembly of Maryland, session of 1896, be and the
same is hereby repealed and re-enacted so as to read as fol-
lows:

352. The taxable limits of said municipal corporation shall
be as follows: Beginning for the same at an iron bolt fixed
in the middle of a stone culvert, it being the first large culvert
west of Middletown, on the National Turnpike road, leading
