518 LAWS OF MARYLAND.

408. All the footways or pavements referred to under the
provisions of this sub-title of this article, shall be paved,
graveled or planked, at least five feet in width from the
curb line.

409. All streets, avenues and alleys that have been or may
be opened, condemned and constructed, or that may be opened,
condemned or constructed for public use under and by virtue
of any of the provisions of this sub-title of this article, and
also all streets, avenues and alleys that have been opened and
constructed for public use, and dedicated by the owner of
the property through which said street, avenue or alley passes,
shall be deemed and taken as public highway of Baltimore
county, and shall be kept in repair by the said Highways Com-
mission, as other roads and avenues of said county.

409A. Two-fifths the width of all streets and avenues in Bal-
timore county shall. be set apart for footways or walks, viz: one-
fifth to be laid off on each side of said streets and avenues.

410. It shall not be lawful for any person to allow swine
to run at large in any part of Baltimore county which lies
within the distance of fifteen miles from the bounds of Balti-
more city.

411. Any person may impound any swine found going at
large in any part of said county not distant from the bounds
of Baltimore city more than fifteen miles, belonging to any
inhabitants thereof; and the owner of such swine, on reclaim-
ing the same, shall pay at the rate of twenty-five cents per
head for every twenty-four hours such swine may have been
impounded, after any swine so impounded shall be adver-
tised by notice in writing, set up at two of the most public
places in the election district wherein such swine may have
been impounded.

412. If any swine shall remain so impounded for five days
after notice given as aforesaid, the party so impounding it or
them may sell the same at public auction, after five days'
notice, set up as provided in the preceding section, for the
payment of costs and expenses, including the said twenty-five
cents per day.

413. All disputes which may arise between the owner of any
swine and the persons so impounding it or them, shall be deter-
mined by a justice of the peace for said county, who may
summon witnesses and decide the matter in controversy.

414. The Board of County Commissioners of Baltimore
county at the time of the annual tax levy, shall make a
special annual levy of ten cents on each one hundred dollars
