514 LAWS OF MARYLAND.

396. If any such examiner or examiners shall die, or refuse
or neglect to file the said bond, or proceed with the duties
required of them by this sub-title of this article, at any time
after his or their appointment, the Highways Commission,
upon application being made them, with satisfactory proof
of the death, refusal or neglect as aforesaid, shall, in case of
the death of any such examiner or examiners, at their next
regular meeting, appoint another or others; and in case of such
refusal or neglect, as aforesaid, they shall give such examiner
or examiners notice, and if he or they shall continue so to
neglect or refuse, as aforesaid, for thirty days thereafter,
they shall appoint another or other examiners.

397. All monies received by any such examiner or examiners
for benefits, or from any other source in connection with the
opening, grading and curbing of any street, alley way or
thoroughfare, under the provisions of this sub-title of this
article, shall be deposited, as hereinbefore required, in some
bank iji the city of Baltimore, to be designated by the Highways
Commission, to the credit of the street, alley-way or thorough-
fare proposed to be opened, graded, paved or curbed, and by
such bank be kept separate from any other funds which said
examiner or examiners may have on deposit in said bank; and
in case of the appointment of another or other examiners,
under the provisions of the preceding section, such monies
shall be paid out by such bank upon the check, order or war-
rant of such other examiner or examiners.

898. Whenever it may be desirable to have an alley laid off
and established and condemned, opened, graded and con-
structed in any portion of the territory of Baltimore county
in which streets and avenues have already been laid off or may
hereafter be laid off under the provisions of this sub-title of
this article, the'owners of a majority of front feet of ground
bounding on such proposed alley may make application to the
Highways Commission in the same manner as for the con-
demning, opening and grading of any street or avenue, or
part thereof, and the width of the proposed alley and the
location of the same must be set forth in said application; and
after said application is presented to the Highways Commis-
sion, all proceedings which can be had or taken for the
condemnation, opening, grading and construction of any street
or avenue, or portion thereof, under the provisions of this
sub-title, of this article, shall be had and taken for the con-
demnation, opening, grading and construction of such pro-
posed alley.

399. Whenever the owners of a majority of front feet of
ground bounding on any street or avenue, or any portion
