such respect as municipal corporations are ordinarily subject.
Whenever it shall become necessary, in its discretion, to lay out
or construct any sewer, drain or ditch, across or under the prop-
erty of any individual or. corporation, for the purpose of drain-
ing the surface water from any public highway heretofore ex-
isting or hereafter dedicated by grant, condemned or declared
to be a public highway, as provided in this sub-title, such High-
ways Commission shall have the power to lay out and construct
the same in the same manner and subject to the same provi-
sions and restrictions, so far as the same may be applicable, as
are provided for the opening, altering, relocating or closing of
county roads, and to assess the benefits and award the dam-
ages arising therefrom in the same manner. When any sewer,
drain or ditch is so constructed for the purpose of carrying off
surface water from the roads as aforesaid, said Commission
shall have the right to allow connections to be made therewith
from private property, upon such terms as it may decide proper
or just. The revenues derived from such source to be applied to
the benefit of the county roads and highways.

358. The Highways Commission shall make no contract for
work or materials of any kind to be done or furnished in con-
nection with any of its duties under this sub-title for an amount
exceeding two hundred dollars in amount, without requiring
the party contracting to do such work for furnishing such
material, to give a bond, with security, to be approved by the
Commission, for the proper performance of such contract, and
shall make no payments on account of such contract, unless the
Roads Engineer of the county shall approve the same.

359. The Highways Commission of Baltimore county shall
have full power to agree and contract with owners of land or
materials, the use of which may be required in connection with
the opening of any new road, the construction or repair of any
bridge, the relocation, straightening or widening of any road,
the proper drainage of the roads of the county, or in connection
with any other of its duties under this sub-title, and if it be
unable for any reason to agree with the owners of any such land
or materials, the use of which is required for any such purposes,
and if other provisions of this sub-title shall not in any such
case be applicable or advisable under the circumstances, said
Commission may proceed to condemn the same under the provi-
sions of the law relative to condemnations by corporations,
municipal or otherwise, as fully as though it were a corporation
named in the several sections of said laws.

360. In all cases where there is any growing timber, build-
ings, stone or other property of value, on any property dedi-
cated to the county by grant for road purposes, opened by the
