458 LAWS OF MARYLAND.

279. It shall be lawful for any person, and shall be the duty
of the constables and police force of Baltimore county, to take
up and impound any horse, mule, horned cattle, goats or swine
which may be found at large and without attendants with-
in the said described city limits; and any constable or other
person so taking up and impounding shall notify a justice
of the peace, resident within said limits, who shall give
notice of said impounding by advertisement at one or more
public places within the same limits, describing the stock so
impounded, and that the same will be sold at public auction
at some public place, within said limits, within ten days; pro-
vided, that if the owner of any stock impounded under this
section shall prove to the satisfaction of the justice of the
peace that the said stock did not go at large from negli-
gence or want of care on his part, and that due diligence was
used to prevent it, the owner shall have return of the property
on paying all expenses of keeping and all costs whatever in-
curred, and one dollar for taking up each of said stock.

280. Said justice of the peace shall be fully authorized to
make sale of such stock if not returned as aforesaid; and out
of all moneys arising from such sale made in execution of the
two preceding sections, he shall pay to the party taking up, if
a constable or public officer, and impounding said stock, one
dollar for his services therein, and also all other expenses
incurred, and the remainder to the owner who may establish
claim to said property; and in the event of no such claimant
appearing within thirty days thereafter, then the balance shall
be paid to the County Commissioners for the use of the county.

281. Every building erected, and every building repaired,
rebuilt or improved in Baltimore county, to the extent of
one-fourth of its value, shall be subject to a lien for the pay-
ment of all debts contracted for work done or materials fur-
nished for or about the same; provided, that nothing in article
63 of the Public General Laws, title "Mechanics' Liens, " except
as provided in section 20 thereof, shall entitle any person, firm
or corporation to the benefit of such lien upon any such build-
ing in Baltimore county for materials furnished for or about
the same, unless the contract for furnishing such material shall
have been made directly with the owner of such building or his
agent.

282. The Board of County Commissioners of Baltimore
County shall annually levy upon the assessable property on
each one hundred dollars of the whole assessable property of
the village of Mount Washington, in Baltimore county, at the
time of making the county levy, a sum of money, not exceeding
the sum of twenty cents, for the use and purpose of the better-
