town; they shall have power to regulate and control all offen-
sive trades, and traffic in offensive or dangerous materials or
commodities within said corporate limits; they shall have power
to provide for the codification of all ordinances which may
hereafter be passed; and for the purpose of carrying out the
foregoing powers and for the preservation of the cleanliness,
health, peace and good order of the community, and for the
protection of the lives and property of the citizens, and to
suppress, abate or discontinue all nuisances within the said
corporate limits of said town, they may pass all ordinances
and laws that the said Mayor and Councilmen may from time to
time consider necessary; and the observances of all ordinances
of said Mayor and Councilmen, in addition to the action of
debt, or such other civil remedies as may exist in such cases
for the recovery of the penalties thereto affixed, they may affix
thereto such reasonable fines, not exceeding fifty dollars in any
case, as to them may seem proper, and in default of payment
of any fine imposed, they may provide for the punishment of
the offender for a period not exceeding twenty days in the
county jail, or until the fine and costs are paid. Instead of the
aforesaid penalties, it shall be lawful, in case of conviction of
any person or persons for vagrancy, to sentence such person
or persons to hard work on the streets and highways of said
town for a period not exceeding ten days.

SEC. 11. And be it enacted, That the Mayor and Councilmen
shall have power to levy an equal tax on the property within
the corporate limits of said town, to such an extent or amount
each year, not exceeding fifty cents on each one hundred dollars
worth of assessed valuations, as they may deem necessary for
the government of said town, which taxes so levied and assessed
shall be collected promptly by the bailiff of said town, and by
said bailiff paid over as collected, or within five days thereafter
to the treasurer of said town; and the bailiff of said town shall
have the same power to distrain for taxes as the treasurer of
Allegany county now has to distrain for the same, and the
said Mayor and Councilmen shall fix the amount of bond, the
rate of compensation and prescribe the duties of the said
bailiff, which said bond shall guarantee the collection of all
taxes imposed by the said Mayor and Council, except such in-
solvencies as may from time to time be allowed by said Mayor
and Council. And the said Mayor and Council may, at any
time after their election held under this Act, appoint two
persons, citizens of said town, to assess and value all property
located in said corporate limits, and shall pass all ordinances
necessary, and to prescribe the duties and powers of said
assessors; provided, however, that the assessment for town
