20. Any sale or transfer of a stock of goods, wares or mer-
chandise out of the usual or ordinary course of the business or
trade of the vendor, or whenever thereby substantially the
entire business or trade heretofore conducted by the vendor
shall be sold or conveyed or attempted to be sold or conveyed,
to one or more persons, shall be deemed a sale in bulk, in con-
templation of this law.

21. Nothing contained in the aforegoing sections shall apply
to sales made by executors, administrators, receivers or any
public officer conducting a sale in his official capacity, nor to
any deed of trust executed for the benefit of creditors.

SEC. 2. And be it enacted, That this Act shall take effect
from the date of its passage.

ARTICLE LXXXV1I.

SHERIFFS.

CHAPTER 372.

AN ACT to repeal and re-enact with amendments section 2 of
article 87 of the Code of Public General Laws of Maryland,
title "Sheriff, " sub-title "Oath of Office and Bonds, " as the
same was repealed and re-enacted by chapter 39 of the Acts
of the General Assembly of 1906.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That section 2 of article 87 of the Code of Public General
Laws, title "Sheriff, " sub-title "Oath of Office and Bonds, " as
the same was repealed and re-enacted by chapter. 39 of the Acts
of 1906, be and the same is hereby repealed and re-enacted with
amendments, so as to read as follows:

SEC. 2. He shall also, before he acts as such, give bond to the
State of Maryland in the penalty of twenty-five thousand dol-
lars, with security, to be approved by the two judges of the
Orphans' Court, or a judge of the Circuit Court for his county,
if he be elected for a county, or by two judges of the Orphans'
Court of Baltimore city, or a judge of the Superior Court of
Baltimore city if he be elected for said city, with condition
that he shall well and faithfully execute the office of sheriff
of county, or the city of Baltimore, in all things apper-
taining thereto, and shall well and truly perform all the duties
required by law to be by him performed; provided, that the
sheriff elected for Somerset, Harford, Calvert, Howard, Carroll,
