PRIVATE ACTS. 1469

SEC. 5. And be it further enacted, That the principal office
of said corporation shall be in Baltimore city, where all meet-
ings of said company and the directors shall be held at such
time as may be fixed upon by the by-laws for the transaction of
the business of the company, and correct minutes of all pro-
ceedings shall be kept and entered in a book, to be open to the
inspection of any stockholder.

SEC. 6. And be it further enacted, That the said corpora-
tion, after being organized as hereinbefore provided, may con-
struct and thereafter keep in repair a bridge over North East
creek or Back river at Chesaco Park, formerly known as New
Warsaw, which is situated at the junction formed by the east
side of Back river and the north side of North East creek, in
Baltimore county, over North East creek or Back river, to a
point on the opposite or outer bank or side of the said North
East creek or Back river, as the directors may select. If across
Back river, it shall be situated between the railroad bridge of
the Philadelphia, Baltimore and Washington Railroad Com-
pany, formerly known as the Philadelphia, Wilmington and
Baltimore Railroad Company, over Back river and the mouth
of North East creek, where it empties into Back river. If
across North East creek, then between the mouth of North East
creek where it empties into Back river, and a point 1,000 feet
easterly from the said mouth of North East creek. It being
understood that only one bridge is to be erected over either
North East creek or Back river, and upon such site as selected
by the said board of directors, and such bridge may be con-
structed out of steel, iron, stone, cement, brick or timber, or
partly of different materials, and for this purpose they may
purchase all such materials, enter into all contracts and agree-
ments as may be needful.

SEC. 7. And be it further enacted, That the said company, or
the president and the directors thereof, or their agent or agents
authorized by them, may agree with the owner or owners of
any land, gravel, stone, timber, materials or any improvements
which may be wanted for the proper construction or repairs
of said bridge or any of its piers, abutments or foundations, or
other needful parts thereof, or for a roadway not exceeding
thirty feet in width, from a point on said bridge to the nearest
county road, for the purpose and use and occupation of the
same, and if they can not agree with such owner or owners, or
if such owner or owners of any of them be an infant, feme co-
vert, not possessed of the property to her separate use and au-
thorized to contract with reference to the same, non compos
mentis, or for any other cause be legally incapable of construct-
ing, application may be made by said company to any justice
