having been given; they shall also have power to purchase and
lease property, real and personal, water rights, powers and
privileges, and to erect thereon all suitable reservoirs, dams,
tunnels, conduits, fountains, engines and machinery, build-
ings and works of the company to collect the water and dis-
pose of same for the purposes hereinbefore stated; they shall
also have the power, with the consent of the County Commis-
sioners of Garrett county, and the authorities of any incor-
porated town through which it may desire to lay its pipes and
mains; to excavate the earth and lay pipes and water mains
under the streets of the town of Bloomington and under the
public roads within five miles of said town of Bloomington,
said streets and roads to be put in as good condition as be-
fore said pipes are laid; to make and pay over to the stock-
holders from time to time dividends of the net profits of the
company; to make rules, regulations and by-laws for the gov-
ernment of said company, its agents and officers, and to take
such bonds from them for the faithful performance of their
duties as may be deemed necessary; to borrow money, if re-
quired by the .said company, and to secure the same by mort-
gage on its property, or otherwise.
SEC. 6. And be it enacted, That the stock of this company
shall be deemed personal estate and shall, with all of the
effects of the company, be liable for its debts, but the stock-
holders shall not be liable therefor; and service of any judi-
cial process on the president shall be sufficient service on the
company.
SEC. 7. And be it enacted, That if the said company shall
not be able to agree with the owner or owners of any land,
springs, water rights or materials of any kind in said Garrett
county or with the County Commissioners for Garrett county,
or if such owner be a feme sole, feme covert or without power
to contract, in that regard, under age, non compos mentis, or
under any other legal disability to contract, or be out of the
county in which the property may lie at the time the same is
wanted, then in all such cases application may be made by
the said company to any justice of the peace for the county or
in the district in which said land, rights or material may lie,
and thereupon the said justice of the peace shall issue his
warrant under his hand and seal directed to the sheriff of the
county of Garrett, requiring him to summons a jury of twenty
inhabitants of said county, not related to the owner or in any-
wise interested in said lands or materials and not a stock-
holder of said company, to meet on the land or near the other
property or material to be valued and condemned, on a day
named in said warrant, not less than ten nor more than twenty
