sion to arrest any person or persons for any offense com-
mitted in said town, whether the offense was committed in the
presence of the officer or otherwise, and the policeman believes
that under the circumstances he ought to make the arrest
without delay, said officer may make the arrest without delay;
said officer may make the arrest without a warrant and may
place the prisoner in the lockup until the following morning at
such hour as a warrant can be obtained. And the policeman
shall perform such other duties mentioned in this chapter or in
the ordinances of the town as the Mayor and Council shall
assign to him. He shall pay over all fines coming into his
hands to the town treasurer monthly, and the amount thereof
shall be entered upon the minutes; the policeman, before enter-
ing upon the discharges of his duties, shall take the required
oath and give bond to the State of Maryland in the sum of two
hundred and fifty dollars, conditioned that he will faithfully
discharge all the duties appertaining to the office of policeman
of Berlin and account for and pay over to the treasurer monthly
all money collected by him and belonging to the said town;
said bond to be approved and recorded in like manner as the
bond of the tax collector. If any vacancy shall occur in the
offices of secretary, treasurer or policeman, the Mayor, by and
with the advice and approval of the Council shall appoint a
successor to serve out the unexpired term for which the
original appointment was made.

41. The tax collector shall perform such duties as may be
assigned to him by this charter and by the ordinances of the
town, but it shall be especially his duty to collect the taxes
levied by the Mayor and Council under the annual levy. He
shall hold his office for one year from the date of his bond
herein recorded and until his successor is appointed and has
qualified by taking the oath of office and filing his approved
bond. For the collection of the annual levy placed in his hands
for collection he shall have a second year after the said first
year has expired, and on his petition the Circuit Court for Wor-
cester county may extend his time six months longer to com-
plete his collection. He shall make monthly settlements with
the town treasurer for all town taxes collected by him under
the annual levy during the previous months, and such settle-
ment shall be entered in full in the minutes of the Council; on
or before the first day of January next succeeding a levy he
shall make final settlement with the town treasurer of so much
of the annual levy as is charged to or due from persons who are
assessed with personal property only upon the assessment
books of the town; on or before the first day of March next
after the levy he shall pay over to the town treasurer not less
