that no property upon which the assessment originally made
for its share of the cost of such improvement shall have been
paid shall be again assessable. Any part of the cost assessed
to the city under the provisions of this section shall be paid out
of the special fund, if one is provided, or general fund of the
city; provided, that before the passage by the Mayor and Coun-
cil of Salisbury of any ordinance under this section ten days'
notice, at least, shall be given in one of the newspapers pub-
lished in said city of the day when any such ordinance is
proposed to be passed by the Council, and an opportunity
shall be afforded to all persons interested therein to appear and
be heard before said Council; and before any assessment made
by the Mayor and Council or its authorized agent under any
ordinance passed under the provisions of this section shall
be finally ratified, ten days' notice at least shall be given in
one newspaper published in said city of the date when said
assessment is to be finally ratified, and an opportunity shall
be afforded all persons interested therein to appear and be
heard. Any person interested feeling aggrieved by the passage
of any ordinance or any assessment made in pursuance thereof
under the provisions of this section shall have the right within
ten days after the passage of an ordinance or final ratification
of any assessment of an appeal to the Circuit Court for Wicom-
ico county.
158G. And be it enacted. That no sidewalk, street or alley
shall be graded or the grade thereof changed or altered in any
manner by anyone except on plan made by a competent sur-
veyor and submitted to and approved by said Mayor and
Council. If any person shall alter or grade, or change the
grade of any sidewalk, street or alley as established, or as it
may be hereafter established, except as aforesaid, he shall be
deemed guilty of a misdemeanor, and on conviction thereof,
shall be fined not less than five dollars and stand committed
to the county jail until the fine and costs are paid; and, in
addition thereto, shall pay all costs and expenses of restoring
said sidewalk, street or alley to its original grade.
158H. And be it enacted, That the Mayor and Council of
Salisbury shall have power to provide by ordinance for the
constructing, opening, enlarging or straightening of any sewer
or drain, and for the regulation of the same; to pave, keep in
repair all necessary sewers and drains or gutters; to provide
by ordinance for the purchase and condemnation of private
or public property as is now provided in this Act for the
condemnation and opening of streets in said city, for the pur-
pose of laying, building and maintaining any sewer or drain
in said city; and to regulate the charge for entering any such
