costs of sale distrained for, but only one-half of said fees shall
be collected if payment be made after distraint and before
sale ; a fee for selling each piece of real estate of four per
cent, on the amount of taxes, interest, penalties and costs of
sale due thereon, but if the same be paid after advertisement
and before sale a fee of three pe.r cent, thereon ; and no fee
shall be charged when any piece of real estate is sold to the
County Commissioners of Prince George's county ; a fee of
four cent, on the amount of sale of any piece of forfeited real
estate ; and a fee of two dollars for each piece of property he
shall list and value and report to said Commissioners for assess-
ment, payable only when the same has been actually assessed
by said commissioners, and no piece of property under the
value of one hundred dollars, shall be listed by him. The
clerk of the Circuit Court shall, upon receiving from the treas-
urer a list of real estate about to be advertised at tax sale, search
for the book and page of the land records in his office relating
to each piece thereof, and he shall receive a fee of twenty-five
cents for finding and furnishing the same to the treasurer.
Said clerk shall receive a fee of five dollars, payable by said
Commissioners for filing a report of tax sales made by the
treasurer as hereinbefore provided, docketing the same and
making entries relative thereto, but upon exceptions to any sale
therein, a separate suit shall be docketed by him upon the
equity docket concerning the same, wherein all subsequent pro-
ceedings shall be had, and he shall receive from the party
requiring any service therein the same fees allowed for similar
services in ordinary equity suits. Said proceedings shall not
be actually recorded, and the result thereof shall ,be entered
by said clerk upon the report of sale, to wit : "Exceptions
dismissed and sale finally ratified," or "Sale set aside," and be
signed by the judge deciding the same.

Repeal

SEC. 2. And be it enacted, That all Acts and parts of Acts
inconsistent with this Act be and the same are hereby re-
pealed.

CHAPTER 223.
AN ACT to repeal and re-enact with amendments Section
thirteen of Article twenty-six of the Code of Public General
Laws of the State of Maryland, entitled "Courts," sub-title
"Inspection of Records," in so far as the same relates to
Frederick County.
