discretion as to the suppression of license. The word "know-
ingly," as used in this article, shall be construed to mean such
knowledge as a reasonable man would have under ordinary cir-
cumstances from the appearance of the person requesting to be
served with such liquors.
325. Any person under the age of twenty-one years who

shall enter a saloon or other place where intoxicating, spirit-
uous or fermented liquors or lager beer are sold and shall ask,
demand or offer to purchase of the proprietor or owner thereof,
or his agent, any intoxicating, spirituous or fermented liquors
or lager beer, kept for sale therein, or who shall knowingly
and wilfully make any misrepresentation or false statement as
to his age, and by reason of such misrepresentation or false
statement shall obtain any spirituous or fermented liquors or
lager beer from any other person or persons licensed to sell
such spirituous or fermented liquors or lager beer under the
laws of this State, shall be deemed guilty of a misdemeanor,
and upon conviction thereof shall be fined not more than
twenty-five dollars, or imprisoned in jail for not more than
thirty days, or both fined and imprisoned in the discretion of
the court; provided, that the testimony given by any minor or
person under twenty-one years of age, in the prosecution of
any person for selling liquors to minors under the laws of this
State, shall not be used against such minor in the prosecution
under this Act, and if any person not a minor shall obtain for
and furnish any minor any spirituous or fermented liquors or
lager beer, from a licensed dealer, he shall be deemed guilty of
a misdemeanor, and upon conviction thereof shall be lined not
more than fifty dollars, or be confined in jail not more than
sixty days.

thereof to another ; provided, that said assignee shall comply
with all the requirements and provisions of this article, in the
same manner as is hereby required of an original applicant for
a license under this article, and upon such transfer, the license
so transferred shall have the consent of the clerk of the Circuit
Court, endorsed on said license, and such assignee shall in
every respect be subject to all the requirements, provisions
and penalties of this article, and also of all privileges and
benefits hereby conferred.

SEC. 2. And be it enacted, That any and all Acts or parts
of Acts inconsistent with this Act, be and the same are here-
by repealed.
