in the house or on the premises while in such state of intoxica-
tion ; that he will not knowingly sell or allow to be sold in the
said house or on the said premises any such liquors on
Sunday or on election days, or to minors at any time,
or allow a minor to drink in said house or on said
premises; that he will not keep or. permit to be kept
a bawdy honse in the said house or on the said prem-
ises, or the gathering together in or the visitation to said
house or premises, of women for lewd or immoral purposes;
second, if the applicant shall reside in the county outside of
Hagerstown in said county, he shall at the same time tile with
the said clerk a writing, signed by at least twelve respectable
freeholders, and who shall reside within a mile of the purposed
place of sale, if such place be situated in any one of the
following villages or towns of the county, viz: Williamsport,
Sharpsburg, Keedysville, Sandy Hook, Boonsboro, Funkstown,
Beaver Creek, Smithsburg, Listersburg, Clear Spring and Han-
cock ; if the proposed place of sale be situated in any other
part of the county at the distance of a mile or more from any
one of these named villages or towns, the said twelve free-
holders shall reside within two miles of the said place of sale,
save and except however, the Blue Mountain House, the pro-
prietors or managers of which may be recommended by twelve
freeholders residing within eight miles, and if the applicant
shall reside in Hagerstown, he shall tile a petition similarly
signed by twelve respectable freeholders, residing in Hagers-
town and in the election district in which is located the pro-
posed place of sale, stating that they personally know the
applicant and believe his statement tiled as above to be true ;
that he will faithfully observe the matter therein sworn to, and
recommend that a license be issued to such applicant; but no
signer of such statement and recommendation shall be per-
mitted to sign more than two such statements or applications,
except in the third election district, where such signers may
sign three such applications, and the clerk of the Circuit
Court is hereby prohibited from issuing a license to any appli-
cant whose statement and recommendation is signed by any
signer who shall have so signed more than contrary to the
restrictions herein provided, under a penalty of not less than
twenty-five dollars, to be recovered before a justice of the peace
as other similar tines are recovered; third, the applicant shall at
the same time, also file with the said clerk a bond with secu-
rity, to be approved by said clerk, in the penal sum of five
hundred dollars for the faithful performance of the matters
and things stated in his application, and for the payment of all
