vacant, and order the election of his successor, as herein pro-
vided, or shall dismiss the petition, as the proof may justify,
and may award costs as may appear equitable and right.

58 A. All vacancies in the City Council shall be filled by the
City Council without delay, from the ward or wards from
which such vacancies occur, or at large, as the case may be ;
provided, that said vacancy shall be hlled by a person of the
same politics as the one who has died, resigned or been re-
moved ; and provided further, that such an election shall be
by ballot, and a majority of the votes of the Councilmen
present who qualified to sit shall be sufficient to elect ; and in
case of a vacancy in the office of Mayor, the president of the
City Council shall act as Mayor until the next city election
and the qualification of his successor ; and at such city election
a new Mayor shall be elected to fill the unexpired term in the
office of Mayor, or for the new term, as the case may be.

58 B. The head of the Department of Law shall be the

attorney and counsel of the city. He shall have the manage-
ment, charge and control of the law business of the city, and
for each branch of its government, and prosecute all violators
of city ordinances, shall be the legal adviser of all its depart-
ments and officers ; shall draw up ordinances, leases, deeds,
contracts, or other legal papers for the city and its various
departments when requested to do so by the proper officer.
He shall conduct all legal proceedings authorized by this Act
and all appeals of every nature whatsoever in which such city
or the public shall have an interest ; shall make all searches
and abstracts of title required in opening, widening or changing
any street, alley or public place, or required in any public
work of any kind ; shall use all diligence to collect cost due
to the city and all other fees or recoveries falling within the
purview of his official duties, and shall promptly commence
all proceedings necessary or advisable for the protection or
enforcement of the rights of the city or of the public. Ho
shall report to the Mayor in writing all such matters as he may
deem important, and to the department of finance all judg-
ments for which the city shall be liable. In all actions in
which the city is entitled to pray an appeal, the same shall be
granted as to such city without bond. No proceedings shall
be had to enforce any judgment against such city pending an
appeal therefrom. And said city attorney, in case of necessity
shall have power and authority, with the consent and written
permission of the Mayor, to secure such detective, expert and
