172. It shall be lawful for any owners of land bordering on
the waters of the Elk, Bohemia, Sassafras and Susquehanna

rivers and their tributaries, and North East river from Turkey
point to the head of said river, or such parts of said river as
may be within the limits of Cecil county, or for any one to
whom said owners may extend the privilege to take or catch
fish from nets or traps known as pound nets, either partly
above or entirely beneath the water of said rivers, from the
first day of August to the tenth day of June next ensuing of
each year ; provided, however, that such pound net shall not
extend across any channel, or shall be so placed as to in any-
wise obstruct the passage of any vessel or boat engaged in
trading in said waters ; nor shall any seine or net be used in
that portion that confines the fish, the meshes of which are less
than one and one-quarter of an inch square when knit.

SEC. 2. And be it enacted, That this Act shall take effect
from the date of its passage.

CHAPTER 435.
AN ACT to prohibit the taking of fish in the waters of Sus-
quehanna and Tide Water canal, between the Baltimore and
Ohio Railroad bridge at Havre de Grace and Lapidum in
Harford County, also in waters of Susquehanna river
between said points, at less distance than one hundred yards
from tow path of said canal, except by rod, hook and line.
SECTION 1. Be it enacted by the General Assembly of Mary-
land, That it shall not be lawful for any person to fish with

gill nets, hauling seines, or set nets of any kind or description,
in the waters of Susquehanna and Tide Water canal between
the Baltimore and Ohio Railroad bridge at Havre de Grace,
and Lapidum in Harford county.
SEC. 2. Any person violating the preceding section shall be

guilty of a misdemeanor, and shall be fined not less than ten
dollars nor more than fifty dollars for each and every viola-
tion, one-half of which tine shall go to the informer, and the
balance to the Board of School Commissioners of Harford
county.

SEC. 3. Be it enacted, That this Act shall take effect from
the date of its passage.
