by-laws, rules and regulations for the direction

and management of said company as may in
their judgment, from time to time, be necessary
for the purposes of their incorporation ; pro-
vided, they are not inconsistent with the consti-
tution and laws of this state and the provisions
of this charter. And the president and directors
of said company, or a majority of them, shall
elect such other officers of said company as may
be provided for by its by-laws, and shall have
power to employ all such agents and servants
for the construction, repair and preservation of
the railway and other property of said company,
and the running of cars and transportation
of passengers thereon, and for the transaction
of all the business of said company as in their
judgment may be necessary.
SEC. 7. And be it enacted, That the company

hereby incorporated shall have the power to
make and construct and maintain a railway,
with double or single track and sidings as they
may deem expedient, for the transportation of
passengers in cars, propelled by horses or in any
other manner than by steam, in and over the
streets of the city of Hagerstown, in this state ;
provided, however, that it shall first obtain the
right to use said streets from the mayor and
city council of said city.
SEC. 8. And be it enacted, That said company

(4) and fourteen (14) years, from any point on
any line of its railway to any other point within

or persons shall wilfully, by any means what-

railway, or any of the cars, works or buildings,
or other property of said company, or place any
obstruction on said railway by means of which
any injury may be done to any of the cars or
horses of said company, or to any person upon
any of said cars, such person or persons shall be
guilty of a misdemeanor, and, upon conviction
thereof, shall be punished by a fine not exceeding
