Chapter 45.

AN ACT to add an additional section, to be
called section one hundred and forty-three cc,
and to repeal section one hundred and forty-
three D of article twenty-one of the Code of
Public Local Laws, entitled " Washington
County," sub-title "Hagerstown," as amended
by the act of eighteen hundred and eighty-
four, chapter fifty-eight, and to enact the fol-
lowing in lieu thereof in amending and revis-
ing the charter of Hagerstown, and in provid-
ing for the government thereof.

SECTION 1. Be it enacted by the General As-

sembly of Maryland, That the following addi-
tional section be added to article twenty-one of
the Code of Public Local Laws, entitled "Wash-
ington County," sub-title "Hagerstown," as
amended by the act of eighteen hundred and
eighty-four, chapter fifty-eight, in amending
and revising the charter of Hagerstown and in
providing for the government thereof.
SEC. 143 CC. And be it enacted, That whenever

the mayor and council shall exercise the power
under section one hundred and twenty-eight of
the charter to cause the sidewalks, curbs and
gutters, or either, along the public streets and
highways of said town to be graded, paved, re-
paired or improved, and such curbs and gutters
to be set and laid, and shall under or by any
ordinance, or order thereof, and in pursuance
of the same direct the said sidewalks and curbs
and gutters, or either, to be graded, paved, re-
paired or improved, set and laid at the expense
of the abutting property, or the owner thereof,
