cided by a jury trial whether any and what
damages he has sustained ; to provide for, col-
lecting and paying the compensation awarded
to any person before any street or alley shall be
so opened or extended, and to enact all ordi-
nances, from time to time, necessary and proper

cilmen proceed to execute any of the powers
vested in them by this section, at least thirty
days notice shall be given on any application
which may be made for the passage of any such
ordinance by advertisement.
SEC. 22. And be it enacted, That the mayor
and councilmen may, when requested in writing

by the owners of a majority of the front feet of
the property on any street or alley or parts,
thereof in said town, cause the same to be
graded, paved or otherwise improved, and levy
the expenses thereof on the property binding on
said street or alley, agreeably to the extent of
such lots thereon, and collect the expenses of
paving, grading, or otherwise improving the
same, as directed in the next succeeding section.
SEC. 23. And be it enacted, That whenever the
mayor and councilmen shall levy any sum of

money on the inhabitants of, or owners of any
property in said town, for the purpose of grad-
ing, paving, or otherwise improving the streets,
lanes or alleys, in said town, or any of them, or
for any other purpose authorized by law, the sum
levied shall be a lien on the lot or lots on which
the same may be levied, or which may be owned
by the person to whom they are chargeable, until
paid ; and, if such sum shall remain unpaid for
sixty days after the same is due, and there shall
be no personal property within the town on which
the bailiff may levy, the same may be levied on
so much of the real estate of the person owning
such taxes as shall, in the opinion of the mayor
and councilmen, be sufficient to pay the same,
