CHAPTER 579.
AN ACT to repeal Sections forty-two and forty-eight of
Article twenty of the Code of Public Local Laws, title
"Somerset County," sub-title "County Commissioners," as
repealed and re-enacted by Chapter three hundred and forty-
six of the Acts of the General Assembly of Maryland,
passed at its January session, in the year eighteen hundred
and ninety-two, respecting the appointment of a clerk to
the Board of County Commissioners, and the drainage and
improvement of the county roads, and to enact the two
following sections in lieu thereof.

Repeal.
|
SECTION 1. Be it enacted by the General Assembly of
Maryland, That sections forty-two and forty-eight of article
twenty of the Code of Public Local Laws, title "Somerset
County," sub-title "County Commissioners," as repealed,
amended and re-enacted by the acts of eighteen hundred and
ninety-two, chapter three hundred and forty -six, be and the
same are hereby repealed, and the two following sections, as
sections forty-two and forty-eight of article twenty of said
local laws, are enacted and substituted in lieu thereof.

Appointment
of cleric.
|
SEC. 42. Be it enacted, That the County Commissioners of
Somerset county, at their meeting next before the first day of
July, eighteen hundred and ninety-four, and every two years
thereafter, are hereby authorized to appoint a clerk to their
board, whose term of office shall be two years from the first
day of July after his appointment and qualification, unless
sooner removed by death, resignation or for incompetency, or
other disqualification for the office, in which case the said

board shall have power to fill such vacancy for the period of
his unexpired term. His salary, not to exceed three hundred
and fifty dollars per annum, shall be fixed by the board of
commissioners; and before entering upon his official duties, he
shall take and subscribe the following oath or affirmation
before one of the County Commissioners, either of whom is

hereby authorized to administer the same : "I do swear or affirm
solemnly that as clerk to the County Commissioners, I will
honestly and faithfully, to the best of my skill and judgment,
execute the duties pertaining to the office which I am about to
assume, without favor, partiality or prejudice, so help me
God."
