SEC. 208. Annually on the first Monday in July, they shall
appoint one or more bailiffs and prescribe his or their duties,
and award such compensation as they may judge right for
services required, and full power is hereby given said com-
missioners to discharge the bailiff for misbehavior or neglect
of duty.

SEC. 209. The bailiff or bailiffs, before entering upon the

power to establish the grades of the streets, lanes and alleys
of the town, and to remove all obstructions therefrom.

and alleys in said town, and to straighten and increase the
width of and to remove all obstructions from those already
used; and if they cannot agree with the owner of the land or
other property necessary for these purposes, or if such be
incompetent to contract or shall reside out of Somerset county,
the value thereof shall be ascertained by a jury of twelve dis-
interested men of the county, having no assessable property
