sheriff of Baltimore county, and the jury be summoned from
the inhabitants of the said city or county, as the case may be ;
and the jury shall be sworn justly and impartially to value the
damages which the Baltimore and Harford Turnpike Company
will sustain by reason of the occupation of such part of the said
turnpike road by the said Baltimore City Passenger Railway
Company for the construction and operation of its railway
thereon as aforesaid; and the sheriff of Baltimore city or Balti-
more county, as the case may be, summoning the jury, shall give
ten days' notice to the said turnpike company of the time and
place of the meeting of such jury; and the said railway com-
pany may make successive applications for the several parts of
the said turnpike road, the use whereof it may from time to time
require; provided, however, the said railroad company shall
not have power to acquire by condemnation right to make use
of the said turnpike road except within the city of Baltimore
and for a distance not exceeding one mile, measured northeast-
wardly, from the place where the said turnpike road is inter-
sected by the eastern boundary line of the said city, so as to
include the village of Lauraville in Baltimore county.

May purchase
stock.
|
SEC. 3. And be it enacted, That the said Baltimore City
Passenger Railway Company be and it is hereby authorized
and empowered to purchase and hold capital stock of the said
Baltimore and Harford Turnpike Company, with the rights
incident to such ownership, and with power at any time to dis-
pose of any or all of the shares of said stock which it may
acquire.

SEC. 4. And be it enacted, That this act shall take effect
from the date of its passage.
