added to article sixteen of the Code of Public Local Laws of
the State of Maryland, title " Montgomery County," and be
annexed under a separate title as " Horses and Carriages at
Livery,"

New sections.

1. It shall be lawful for any livery stable keeper in Mont-
gomery county to retain in his custody any horse, mare or
gelding placed under his care for livery, and also any vehicle,
until all charges for so keeping the same shall have been paid
by the owner; and if such owner or agent of his shall, when
using such horse, mare, gelding or vehicle, fail to return the
same to such livery stable keeper, with intent to evade pay-
ment of any livery charges due and unpaid, then it shall be
lawful, at any time within thirty days from the date of such
failure to return said property, for such livery stable keeper to
follow and seize such horse, mare, gelding or vehicle, and to
sell the same as provided in section two of this article.

2. It shall be lawful for such livery stable keeper to sell any
such horse, mare, gelding or vehicle at public auction for cash,
in said Montgomery county, after giving at least three weeks'
public notice of the time, place and terms of sale in one or
more newspapers published in said county, prior to the day of
sale, and after deducting the amount due for keeping, together
with all expenses attending such sale, then to pay over the
surplus, if any, to the owner.

3. Before proceeding to sell such horse, mare, gelding or
vehicle as above, it shall be necessary for such livery stable
keeper to state an account for the keeping of such horse, mare,
gelding or vehicle, and prove the same before a justice of the
peace for said Montgomery county, who, upon being satisfied
by proof of demand and refusal or neglect to pay on the part
of the owner, shall thereupon issue his warrant authorizing
such sale as aforesaid; provided, that the proprietor of such
livery stable shall set upon his premises, in some conspicuous
place, a copy of the two aforegoing sections, printed in large
type, and his rates of livery.

Account to be
stated.

SEC.2. And be it enacted, That this act shall take effect
from the date of its passage.

Approved March 21st, 1894.
