SEC. 80. Any person violating the aforegoing section shall
be deemed guilty of a misdemeanor, and on conviction thereof
before any justice of the peace of Anne Arundel county, shall
pay a fine of ten dollars for each and every partridge, quail,
woodcock, pheasant, robin or rabbit, shot or taken, or sold or
exposed for sale, or carried or cause to be carried out of the
limits of said county, one-half of said fine imposed to be paid
to the informer, the remainder of said fines imposed shall be
paid to the board of county school commissioners of Anne
Arundel county, for the use of the public schools in said
county; and on failure to pay said fine and costs, shall be com-
mitted to the house of correction or the county jail for ten
days, in the discretion of the justice trying the case.

Penalty.

SEC. 81. It shall not be lawful for any person, not a bona
fide resident of Anne Arundel county, to shoot, kill, catch or
in any manner entrap or destroy any partridge, quail, wood-
cock, pheasant, rabbit or any kind of game in said county, or
to gun within the limits of said county, at any time; and any
person violating this section shall be deemed guilty of a mis-
demeanor, and on conviction thereof before any justice of the
peace of Anne Arundel county shall be fined not less than ten
dollars nor more than fifty dollars, and upon failure to pay
said fine and costs shall be committed to the house of correc-
tion for not less than one month nor more than three months,
in the discretion of the justice trying the case; one-half of
said tine imposed shall be paid to the informer, and the
remainder of said fines imposed shall be paid to the board of
county school commissioners of Anne Arundel county for the
use of the public schools in said county; and in addition to
said fine shall in every case have the gun and the gaming
apparatus in his possession at the time of the violation of this
section confiscated and sold by judgment of the justice before
whom he is tried; and the money arising from such sale shall
be returned to the County Commissioners of Anne Arundel
county, after having deducted therefrom the cost of such pro-
ceedings of condemnation and sale, to be by them applied to
the public road fund of the district of said county wherein
said violation shall occur; provided, that any land owner may
extend the privilege of killing said game upon his own land tc
whomsoever he may.
