and their successors, be and they are hereby created and
made a body politic and corporate by the name of the " Fort
Frederick Protective Society," and by that name shall have
succession, with full power and authority to provide for the
admission or rejection of members, and to make all by-laws
necessary for the government of the society; to have and use
a common seal; to purchase and take by deed, or otherwise,
the real, personal or mixed estate hereinafter described for
the purposes hereinafter declared, and the same, or any part
thereof, to dispose of as hereinafter provided, and to sue and be
sued, plead and be impleaded, at law or in equity, to receive
subscriptions and donations in money by gift, bequest or de-
vise, and perform whatever any corporation, any body politic
or individual may, can or might lawfully do, execute and per-
form, within the scope, and for the objects and purposes of
said corporation as hereinafter provided, and within the
limitation of the powers hereinafter enumerated and herein
to said corporation granted.

SEC. 2. And be it further enacted, That said corporation
shall have power to acquire by gift, devise, lease, purchase
or condemnation, the land in Washington county, Maryland,

upon which the stone structure known as " Fort Frederick "
now stands, together with said stone structure known as
"Fort Frederick," and such lands adjoining thereto, as may be
necessary and proper to protect, preserve, repair and restore
said stone structure and provide access thereto for the public,
for the purpose of caring for, preserving and protecting the
same, and for opening up and improving avenues, roads and
modes of access to the same for the public, and for fencing
the same, and for properly marking the same with tablets,
having reference to the study and correct understanding of
the origin and historical significance of said " Fort Fred-
erick ;" said tablets each bearing a brief historical legend,
and when thereto required by the State of Maryland to
convey the same to said State of Maryland freely and with-
out any expense or charge to said State of Maryland; the
said corporation, by its officers or agents, authorized by said
corporation, may agree with the owner or owners of the
lands and stone structure known as Fort Frederick, herein-
before mentioned, for the purchase and use and occupation
of the same; and if they cannot agree, or if the owner or
owners or any of them be an infant feme covert, who is not
