properly have incurred in the discharge of its duty, and no
part of said proceeds of sale of said bonds shall be paid out
by said school treasurer except on the warrant of said build-
ing committee.

CHAPTER 123.
AN ACT to enable the Mayor and City Council of Baltimore
City to appropriate money to compensate Arthur W.
Shanklin for the loss of a spring.
WHEREAS, The Mayor and City Council of Baltimore
caused to be constructed a water tunnel or conduit in Balti-

more county, which runs through the property of Arthur W.
Shanklin, in connecting Loch Raven with Lake Montebello ;
and
WHEREAS, The said tunnel has drained and caused to
go dry a large and valuable spring on the property of said
Arthur W. Shanklin, depriving him for all time of the water
therefrom, leaving him without any water supply whatever,
doing him incalculable damage, and causing him the expense
and inconvenience of obtaining water from a long distance
by means of pipes; and
WHEREAS, The damages allowed said Arthur W. Shanklin
for the right of way through his property, before the said
tunnel was constructed, were merely nominal, and did not
take in consideration the loss of the aforesaid spring, the
testimony of the expert engineers for the city being that the
said spring would not be affected; and
WHEREAS, The city of Baltimore has received all the water
from the said spring since the said tunnel was constructed,
and will continue to do so as long as the same shall exist ;
and
WHEREAS, The said Arthur W. Shanklin has never been
paid for the loss of his spring; therefore,
SECTION 1. Be it enacted by the General Assembly of Mary-
land. That the Mayor and City Council of Baltimore city
