working under Henry Smith & Sons, material for the con-
struction of the State House annex to the amount of three
hundred and thirty-one dollars and forty-nine cents, which
material was used in the construction of said annex, and
which amount the said Culver & Fitzpatrick refused to pay ;
and
WHEREAS, Under the laws of this State a mechanics' lien
cannot be laid upon State property; and
WHEREAS, Under the circumstances it was the duty of the
said Henry Smith & Sons to see to the payment of all
materials,
SECTION 1. Be it enacted by the General Assembly of Mary-
