CHAP. 631.

Council on the second Monday in May after each election to
receive the returns of the same, without pay.

Returns to be
opened
by presiding
officer, etc.

SEC. 7. At such meetings of the Mayor and Common Coun-
cil, the returns shall be opened by the presiding officer, and
certificates of election shall forthwith be issued by the clerk to
the persons appearing to be elected as Councilmen, by having
received the highest number of votes, and the said certificate
shall be recorded among the proceedings.

New election
in case of
tie vote.

Sec. 8. If at any election it shall appear from the returns
of the judges of election that any two or more persons voted
for as Mayor or Common Councilman have received the same
number of votes, so that there is no choice for the office, a
new election shall be immediately proclaimed by the Mayor to
fill the vacancy, which election shall be held on ten days'
notice, and in all respects as aforesaid.

Treasurer to
be elected.


SEC. 9. And be it enacted, That on the same day on which
the Mayor and Common Council are to be elected under this
Act, and on every first Monday in May in each and every second
year thereafter, one person, a legal voter in said town and
owner of real estate of the value of at least one thousand
dollars, may be chosen by the voters of said town as treasurer
of said corporation to serve for two years and until his suc-
cessor shall qualify ; but before said treasurer shall enter upon
his duties of this office he shall give bond, payable to said
Mayor and Common Council, in such penalty as they may fix,
with securities to be approved by them, conditioned as they
may direct; and the said treasurer shall qualify and enter upon
the duties of his office on or before the first Monday in June
succeeding his election, and a failure to qualify within the
time herein specified shall be deemed a refusal to accept the
office, whereupon the Mayor and Common Council shall order
& new election to fill the vacancy, and it will be the duty of
the Mayor and Common Council to cause to be issued a cer-
tificate of election to the person receiving the highest number
of votes for treasurer of said town, and in case of a tie vote
for the office of treasurer, the Mayor and Common Council
shall order a new election.

Authority to
make all
collections of
taxes and
receive
money, etc.

SEC. 10. And be it enacted, That the treasurer shall make
all collections of taxes and receive all money paid for the use
and benefit of said corporation ; he shall keep an account of
the receipts and disbursements of the funds of the corporation
in a well bound book, to be provided by the said Mayor and
Common Council for that purpose, and shall lender due account
to the Mayor and Council when required by them, for all
moneys received by him, and shall promptly disburse on the
order of the Mayor and Common Council, under such regula-
