be punished by a fine of not less than one nor more than ten
dollars for the first offense, and for each subsequent offense in
reference to the same place or thing be fined not exceeding
twenty five dollars; provided, nothing in this Act shall apply
to Baltimore county.
SEC. 2 And be it enacted, That this Act shall take effect
from the date of its passage.

CHAPTER 476.
AN ACT to amend the charter of the Burgess and Commis-
sioners of Middletown, in Frederick county, by repealing
and re-enacting with amend ments Section three hundred and
fifty-one of Article eleven of the Code of Public Local Laws
of Maryland, title "Frederick County," sub-title "Middle-
town," as repealed and re-enacted by the General Assembly
of Maryland, Acts of 1896, Chapter 96, and to add an addi-
tional Section thereto to follow, Section 359 of said Article,
to be designated as Section 359 A.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That section three hundred and fifty-one of Article
eleven of the Code of Public Local Laws of Maryland, title
"Frederick County," sub-title "Middletown," as repealed and
re-enacted by the General Assembly of Maryland, Acts of
1896, Chapter 96, be and the same is hereby repealed and
re-enacted, so as to read as follows :

and re-enact.

351. The citizens of Middletown, in Frederick county,
residing within the metes and bounds, courses and distances
set out in the next succeeding sections as the taxable limits of
said town, are a body corporate by the name of the Burgess
and Commissioners of Middletown, and by that name may
sue and be sued, and have and use a common seal.

SEC. 2. And be it enacted, That the following additional
section be- added to said Article eleven of the Code of Public
Local Laws of Maryland, to follow section 359 of said Article,
and to be known and designated as Section 359 A, to read as
follows :
359 A. The Burgess and Commissioners of Middletown
shall have power to provide for the laying out, opening, grad-
ing, widening and extending any street or alley within the
taxable limits of said town, and may fix the dimensions
thereof, which in their judgment the public welfare or con-
venience may require; to provide for ascertaining whether
