justice, together with the costs of prosecution, such persons
shall be committed by said justice to the custody of the
sheriff for thirty days, unless said fine and costs be sooner
paid.
Section 38 E. Be it enacted, That this Act shall take effect
from the date of its passage.

CHAPTER 435.

AN ACT to refund to the Baltimore, Westminster and
Gettysburg Railroad Company a certain sum of money
erroneously paid by it into the State Treasury.

CH AP. 438.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That the Comptroller of the Treasury be and he is
hereby authorized and directed to issue his warrant upon the
Treasurer in favor of the Baltimore, Westminster and Gettys-
,burg Railroad Company, a body corporate, of the State of
Maryland, for the sum of one hundred and twenty-five dollars,
being the amount erroneously paid into the treasury by the
fiaid railroad company as a bc.ni us tax on its capital stock as
certified by the Comptroller and Treasurer, the refunding
thereof having received the recommendation of said officers.
SEC. 2. And be it enacted, That this Act shall take effect
from the date of its passage.
Approved April 8, 1902.

CHAPTER 436.

AN ACT to Incorporate the Seaboard Investment, Guarantee
Title and Trust Company.

Warrant to be
issued.

SECTION 1. Be it enacted by the General Assembly of
.Maryland, That Theodore Hooper, James E. Hooper, John
R. Dorsey, Rufus K. Goadnow, Joshua R. Jolly and their
associates and successors, and all other such persons as shall
hereafter become stockholders in the company hereby incor-
porated shall be and they are hereby constituted a body politic
and corporate by the name and style of the Seaboard Invest-
ment, Guarantee Title and Trust Company, and by that name
shall have perpetual succession, and be capable in law to
acquire and hold and in anywise dispose of property, and sue
and be sued, plead and be impleaded, in any Court whatsoever ;
to make and use a common seal, and to alter the same at
pleasure, and generally to do anything proper to carry into
effect the provisions of this Act, or promote the objects and
