CHAP. 427.

Disposition
of money
received from
license fees.

Section 311 L. The clerk of the Circuit Court fur Frederick
county shall, from the moneys so received for such licenses
mentioned in the preceding sections, pay, first, to the State of
Maryland the amount now received by it for such licenses in
said city of Frederick, and the excess, over and above the sum
now charged by the State for such licenses in said city shall
be paid by eaid clerk unto the Mayor and Aldermen of Fred-
erick, to be used by the said corporate authorities of said city
as in their discretion they may deem proper.

Druggists
and
apothecaries
not required
to obtain
license.

Section 311 M. Druggists and apothecaries shall not be
required to obtain license under the provisions of this Act, but
they shall not sell intoxicating liquors nor compound or mix
any composition thereof, except upon the written prescription
of a regular physician, nor more than once on any one pre-
scription of any physician, and said prescription shall be filed
and preserved by the druggist or apothecary tilling the same,
and upon complaint, verified by affidavit, shall be produced
before the Circuit Court for said Frederick county when
required, and any failure to comply with the provisions of
this section shall render such druggist or apothecary so failing
liable to the same penalties as if he had sold intoxicating
liquors without license.

Penalty
for violation.

Section 311 N. Any person who shall hereafter be convicted
of selling intoxicating, spirituous or fermented liquors or any
admixture thereof in the said city of Frederick without a
license under the provisions of this sub-title, shall be
sentenced to pay a tine of not less than one hundred dollars
nor more than tive hundred dollars, or undergo imprisonment
in the jail of Frederick county for not less than three
months nor more than twelve months, or to both fine and
imprisonment, in the discretion of the Court.

How to
be construed.

Section 311 o. Nothing in any of the preceding sections
shallbe construed to authorize said clerk to issue any license
for the sale of spirituous or fermented liquors or lager beer
within the police limits of said city of Frederick or within
the district limits of Election District No. 2 of said Frederick
county, to any person from whom the grand jury of said
county have heretofore recommended or may hereafter recom-
mend that a license be withheld, or to any person whose
license may have been or may hereafter be suppressed by the
Court.

SEC. 2. And be it enacted, That this Act shall take effect
from and after the first day of May in the year 1902.
