opposite the property now owned by Benjamin Zimmerman,
to the fifth milestone on said pike opposite the property now
owned by Maurice Rhoderick, and on all public roads within
a radius of one and one-half miles from the public school
house in Feagaville, Frederick county, Maryland.

CHAP. 407.

Section 139 B. Be it further enacted, That for each
horse, cow, calf, hog or sheep found running at large or
pasturing upon the above-described turnpike and between and
within the above-named limits, the owner or owners thereof
shall, when adjudged guilty of the violation of this law, pay
a fine of one dollar ($1.00) for each head of such livestock
found at large or pasturing between the above-named limits.
And they shall also pay the costs of the prosecution.

Penalty
for violation.

Section 130 C. Be it further enacted, That any justice of
the peace of Frederick county shall have jurisdiction of any
violation of this Act. Any person offending against the pro-
visions of this Act and being convicted thereof, shall forfeit
the fine named in this Act. The amount of such fine shall be
paid, one-half to the informer and the other half shall be paid
to the County Commissioners for Frederick county, for the
use of said county ; and if the offenders shall fail to pay the
tine and costs he or they shall be committed to the jail of
Frederick county for every such offense for not less than ten
nor more than sixty days.

Justice of the
peace
may have
jurisdiction.

Section 139 D. Be it further enacted, That any one who
has been adjudged guilty of a violation of this law by a
'justice of the peace as aforesaid, shall have the right to
appeal from said judgment to the Circuit Court of said county,
but sentence to jail shall not be stayed unless he gives a bond
to the State of Maryland in the penalty of fifty dollars ($50)
to prosecute said appeal with effect at the next term of said
Court, which said bond shall be liable for said fine and all
costs of the prosecution to that amount.

SEC. 2. And be it further enacted, That this Act shall take
effect from the date of its passage.

CHAPTER 408.
AN ACT to repeal. Section 9 of Article 52 of the Code of
Public General Laws of the State of Maryland, and to
re-enact the same with amendments.

Appeal may
be taken.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That section 9 of Article 52 of the Code of
Public General Laws of the State of Maryland, be and the
same is hereby repealed and re-enacted, so as to read as
follows :
