CHAP. 401.

majority of the stockholders of such companies or corpora-
tions, and the consolidated company shall have all the powers
and privileges of the companies so consolidating ; provided,
that said corporation shall be subject at all times to the pro-
visions of the Acts of eighteen hundred and ninety-two,
chapters 109 and 279, or amendments or supplements thereto.
SEC. 13. And be it further enacted, That this Act shall take
effect from the date of its passage.

CHAPTER 4ul.

AN ACT to pay Milbourne Elliott, of Dorchester Courty,
State of Maryland, the sum of twelve hundred dollars, dam-
ages sustained by him on account of being shot and wouded
by an officer of the Maryland Oyster Navy.

Preamble.

WHEREAS, On the 27th day of September, A. D. 1899,
Milbourne Elliott, while then pursuing his lawful avocation,
was shot and seriously wounded by Milbourne Cannon, the
mate and person in charge of the oyster police schooner
"Folly ;" and
WHEREAS, The said Milbourne Cannon, an officer and agent
of the State of Maryland, as aforesaid, was, on the 15th day of
November, A. D. 1899, indicted by the grand jury of the
State of Maryland, for the body of Somerset county, for
assault with intent to kill and murder him, the said Milbourne
Elliott; and
WHEREAS, On the first day of May, A. D. 1900, the said
Milbourne Cannon was convicted upon said charge ; and
WHEREAS, The said Milbourne Cannon, at the time of the
said assault and shooting, was an officer of the State of Mary-
land, undertaking to act in the due course of his employment
by the Stare ; and
WHEREAS, The said Milbourne Elliott, because of the
injuries inflicted upon him by the said Milbourne Cannon, the
State's officer and agent, sustained permanent injuries, by
virtue of which he has for a long time been out of employ-
ment, was put to great expense in attending to his said wounds,
and was otherwise damaged ; and
WHEREAS, The said Milbourne Elliott is a citizen of the
State of Maryland, and by reason of said citizenship is unable
to obtain redress through the Courts of the State.
SECTION 1. Be it enacted by the General Assembly of
Maryland, That the Comptroller of the State be and he is
