and forty-eight to two hundred and fifty-three of said Article
twenty-three; provided, however, that if the same be situate
partly in one county and partly in an adjoining county, the
said condemnation proceedings may be instituted and carried
on in either one of said counties with like effect as if the same
were wholly situate in the county wherein said proceedings
are conducted; but it is expressly provided, that the right of
condemnation hereby granted to said company, or that it may
otherwise have under the General Laws, shall not be construed
to authorize it to acquire in that way, any of the lands, rights,
privileges or property now used, owned or occupied by the
Conowingo Bridge Company or the Susquehanna Water-power
and Paper Company of Harford county, in Cecil county or
Harford county, in the State of Maryland.

struct, works,
etc.

SEC. 4. And be it further enacted, That said company is
hereby authorized to exercise its powers and franchises, con-
struct, maintain, supervise and operate its works, plants, or
any part thereof, distribute and dispose of its electricity and
power, or any part thereof, for application to any useful pur-
pose, and generally transact its business, or any part thereof,
in the city of Baltimore, but the assent and approval of the
Mayor and City Council of Baltimore city shall be obtained
before using the streets or highways of said city, either the
surface or ground beneath the same; and said Mayor and
City Council are hereby fully authorized to pass an ordinance
or ordinances giving their assent and approval, and designat-
ing the manner of using the said streets and highways; and
that in the exercise of the powers of condemnation by said
company for the acquisition, use and occupation of land or
property, or any easement therein, or right appurtenant there-
to, or materials for the uses, objects and purposes of the com-
pany within the city of Baltimore, in the manner provided in
section 3 of this act, the Superior Court of Baltimore City,
the Court of Common Pleas, and the Baltimore City Court,
and the clerks thereof, and the sheriff of said city, and the
jurors summoned by him from the inhabitants of said city,
and any justice of the peace of said city, and all parties inter-
ested in the exercise of said powers of condemnation, shall,
respectively, have the same powers and rights which are con-
ferred under section 3 of this act upon the circuit court of
said counties and the clerks thereof, and the sheriff of said
counties, and the jurors summoned by him from the inhabi-
tants of said county, and the justices of the peace of said
county, and the parties interested in the exercise of the powers
