who shall be elected by said board, and one-third of this
number shall be residents of the State of Delaware; and
the present board of directors shall have power to fill vacan-
cies in said board so as to bring it up to the required
number until the next annual election of directors as set by the
laws of said company.

SEC. 6. And be it enacted, That all powers of condemna-
tion of land, of rights of way, or of crossings of highways,
railroads or other rights in the nature of rights of eminent
domain, shall be executed in this State according to the laws
and usages of this State.

from the date of its passage.

CHAPTER C6.

AN ACT to repeal and re-enact with amendments Section
fif ty nine of Article twelve of the Code of Public Local
Laws, title " Garrett County," sub-title " County Treas-
urer."

Effective.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That section fifty-nine of Article twelve of the Code of
Public Local Laws, title " Garrett County," sub-title " County
Treasurer," be and the same is hereby repealed and re-enacted
with amendments, so as to read as follows :

: Repeal.

59. The said treasurer shall receive as compensation for all
the services required of him under this sub-title of this article,
three per cent, on all taxes actually collected by him; and
should said treasurer find it necessary for his convenience at
any time to appoint a deputy, he shall pay said deputy out of
his commissions, and he shall be answerable for the acts of
such deputy, and the County Commissioners shall at the timt
of making the annual levy,, levy a sufficient sum, by estimate
to cover the discount to taxpayers and compensation to the
treasurer, provided for in the preceding sections.

from and after the third Tuesday of April, 1898; provided
