LAWS OF MARYLAND.

Prosecutions.

SEC. 16. And be it enacted, That all prosecutions for the
violation of any of the provisions of this act shall be upon pre-
sentment and indictment, but any justice of the peace of the
said county shall have the same authority to receive information
of violations thereof and to take recognizances and bail, or to
commit, as is now exercised by justices of the peace under the
Public General Laws of this State.

SEC. 17. And be it enacted. That in any indictment for vio-
lation of the provisions of this act, it shall not be necessary,
except in the case of cider, to specify the particular kind of
liquor which may be sold or given away, or solicited, or received,
ordered for the purchase of, or kept deposited, or had with
intent to be sold or given away, in violation of said provisions;
but it shall be sufficient if the indictment set forth that the
traverser bartered, sold, or gave away, or solicited, or received
orders for the purchase of, or kept, deposited, or had with intent
to barter, sell or give away any spirituous or fermented liquors
or intoxicating drinks, or with the intent that the same be bar-
tered, sold or given away, in violation of the said provisions ,
and this law shall be liberally construed to prevent any viola-
tion thereof.

Effective.


SEC. 3. And be it enacted, That this act shall take effect
from the date of its passage.

CHAPTER 196.

AN ACT to prohibit the issuing of any license for the sale
of spirituous or fermented liquors or lager beer within a
mile of Public School No. 2, located at Evergreen, in the
Ninth Election District of Baltimore county, and to prevent
the sale of all kinds of intoxicating drinks in the above
described limits.

SECTION 1. Be it enacted by the General Assembly of Mary-

mented liquors or lager beer at any place within a mile in any
direction of Public School House No. 2, located at Evergreen
