LAWS OF MARYLAND.

Effective.

SEC. 2. And be it enacted, That this act shall take effect
from the date of its passage.

Approved March 27th, 1896.

CHAPTER 109.

AN ACT to repeal Section eleven (11) of Article thirty-five
(35) of the Code of Public General Laws, title "Evidence,"
sub-title "Attendance and Pay of Witnesses," so far as the
same applies to Washington county, and to re-enact the
same with amendments, to be known as Section four hun-
dred and twenty-five A, to follow Section four hundred and
twenty-five, Code of Public Local Laws, title "Washington
County," sub-title "Witnesses."

SECTION 1. Be it enacted by the General Assembly of Mary-

applies to Washington county, be and the same is hereby

New section

repealed and re-enacted with amendments, to be known as sec-
tion four hundred and twenty-five A, to follow section four
hundred and twenty-five, Code of Public Local Laws, title
"Washington County," sub-title "Witnesses," so as to read as
follows :

Pay of

witnesses.

425 A. A witness summoned before a justice of the peace
shall be allowed thirty-three (33) cents per day for each day's
attendance, and in all criminal cases when the judgment is in
favor of the defendant, the justice of the peace before whom
the same are tried, shall certify the amount due each witness
summoned and attending said trials on both sides; and in cases
where the judgment is in favor of the State and the defendant
is unable to pay the costs, he shall in like manner so certify
the amounts due each witness summoned by the State therein
and attending such trials; and upon presentation of such cer-
tificate, the County Commissioners shall pay to such witness
the amount of fee so certified to by the justice of the peace.

Effective.
